WaterTech Website Terms of Use and Privacy Policy

1. General Provisions
These Website Terms of Use (hereinafter — the "Terms") govern the use of the official website of WaterTech (hereinafter — the "Company", "we", "us") and the relationship between the Company and website users (hereinafter — "Users", "you").
WaterTech operates in the field of water supply, wastewater management, and hydraulic engineering: we design, manufacture, install, and maintain the relevant equipment and systems.
By using the website, you confirm that you have read these Terms, fully understand their content, and accept their conditions. If you disagree with any condition, you must immediately stop using the website.
These Terms have been developed in compliance with the personal data protection legislation of the Republic of Kazakhstan, the Russian Federation, and the European Union.
2. Use of the Website
2.1. Permitted Use
The website is intended to provide information about WaterTech's activities, services, and products, and to facilitate interaction with prospective and existing partners and clients.
Users may:
- browse and study materials published on the website;
- use contact forms and communication channels to submit inquiries;
- download publicly available materials (presentations, technical descriptions) for personal non-commercial use;
- link to the website in publications provided that attribution is preserved.
2.2. Prohibited Actions
Users are prohibited from:
- copying, reproducing, or distributing website content without the Company's written permission;
- using the website for purposes contrary to applicable law;
- taking actions that disrupt the operation of the website or its infrastructure;
- posting false, misleading, or offensive information;

Any use of website materials without the Company's prior written consent is prohibited and entails liability under applicable law.
4. Personal Data Processing Policy
4.1. Data Controller

4.2. Categories of Data Processed
The Company may process the following categories of personal data:
- identification data: last name, first name, patronymic;
- contact data: email address, phone number, postal address;
- professional data: job title, organisation name;
- technical data: IP address, browser data, cookies, website activity data;
- correspondence data: content of requests submitted via feedback forms.
4.3. Purposes of Processing
Personal data is processed for the following purposes:
- processing incoming inquiries and commercial proposals;
- performance of concluded contracts and obligations;
- sending informational and marketing materials (subject to consent);
- improving website quality and user experience;
- compliance with applicable legal requirements;
- protection of the Company's legitimate interests.
4.4. Legal Bases for Processing
Personal data is processed on the following legal bases:
- consent of the data subject (Art. 8 of the RK Law No. 94-V; Art. 9 of Federal Law No. 152-FZ; Art. 6(1)(a) GDPR);
- performance of a contract to which the data subject is a party (Art. 6(1)(b) GDPR; Art. 6 of the RK Law No. 94-V);
- compliance with a legal obligation (Art. 6(1)(c) GDPR; Art. 6 of Federal Law No. 152-FZ);
- legitimate interests of the Company that do not override the rights of the data subject (Art. 6(1)(f) GDPR).
5. Compliance with the Legislation of the Republic of Kazakhstan
Processing of personal data of citizens of the Republic of Kazakhstan is carried out in accordance with the Law of the Republic of Kazakhstan No. 94-V dated 21 May 2013 "On Personal Data and Their Protection".
The Company ensures:
- processing of personal data only for the purposes specified at the time of collection;
- obtaining the data subject's consent where required by law;
- confidentiality of personal data and implementation of protective measures;
- the right of data subjects to access, rectify, and delete their personal data;
- notification of the competent authority in cases provided for by Kazakhstani law.
When transferring personal data of Kazakhstani citizens to third parties, the Company ensures the existence of adequate contractual data protection guarantees in accordance with Kazakhstani law.
6. Compliance with the Legislation of the Russian Federation
Processing of personal data of citizens of the Russian Federation is carried out in accordance with Federal Law No. 152-FZ dated 27 July 2006 "On Personal Data" and other applicable regulatory acts of the Russian Federation.
The Company ensures:
- storage of personal data of Russian citizens on servers located within the Russian Federation, in accordance with Art. 18.1 of Federal Law No. 152-FZ;
- notification of Roskomnadzor regarding personal data processing activities;
- implementation of organisational and technical measures to protect personal data against unauthorised access, modification, disclosure, and destruction;
- the ability of data subjects to exercise their rights: access, rectification, erasure, restriction of processing, and withdrawal of consent.
The retention period for personal data is determined by the purposes of processing and does not exceed the periods established by Russian law. Upon expiry, data is subject to anonymisation or deletion.
7. Compliance with EU Legislation (GDPR)
With respect to data subjects located in the European Union, the Company applies the requirements of the General Data Protection Regulation (GDPR, Regulation (EU) 2016/679).
Under the GDPR, data subjects have the following rights:
- right of access (Art. 15 GDPR): obtaining information about the processing of personal data;
- right to rectification (Art. 16 GDPR): requesting correction of inaccurate data;
- right to erasure — "right to be forgotten" (Art. 17 GDPR);
- right to restriction of processing (Art. 18 GDPR);
- right to data portability (Art. 20 GDPR);
- right to object to processing (Art. 21 GDPR);
- right to withdraw consent at any time without affecting the lawfulness of processing carried out prior to withdrawal.
The Company does not carry out automated decision-making that significantly affects data subjects without their direct involvement.
In the event of a personal data breach, the Company notifies the competent supervisory authority within 72 hours, and where the breach is likely to result in a high risk to data subjects' rights, notifies the data subjects directly.
EU data subjects have the right to lodge a complaint with the data protection supervisory authority in their EU member state of residence.
8. Cookies and Technical Data
The website uses cookies and similar technologies to ensure website functionality, analyse traffic, and improve user experience.
Types of cookies used:
- essential — ensure basic website functionality and do not require consent;
- analytical — enable analysis of website usage (used only with the user's consent);
- marketing — used for targeted advertising (only with explicit consent).
You may manage cookie settings via the consent banner displayed on your first visit, as well as through your browser settings. Declining certain types of cookies does not affect access to the main content of the website.
9. Transfer of Data to Third Parties
The Company does not sell or transfer Users' personal data to third parties for commercial purposes without the consent of data subjects, except as required by law.
Personal data may be transferred to:
- authorised public authorities — on the basis of mandatory legal requirements;
- technical partners and service providers — to the extent necessary to perform specific functions (hosting, analytics, mailings), subject to the conclusion of data processing agreements;
- successors in the event of reorganisation or sale of the business — in compliance with applicable data protection law.
When transferring data outside the Russian Federation, the Company ensures an adequate level of protection in accordance with the requirements of Russian, Kazakhstani, and EU legislation.
10. Exercising Data Subject Rights

The Company reviews requests and responds within the following timeframes:
- for data subjects in Kazakhstan: within 15 business days from receipt of the request (RK Law No. 94-V);
- for data subjects in Russia: within 30 days from receipt of the request (Art. 20 of Federal Law No. 152-FZ);
- for EU data subjects: within one calendar month, extendable by up to two months in exceptional cases (Art. 12 GDPR).
11. Data Security
The Company implements a set of organisational and technical measures to ensure the security of personal data, including:
- encryption of data in transit via HTTPS;
- access control based on the principle of least privilege;
- regular security audits and software updates;
- staff training on personal data protection requirements;
- maintenance of data processing logs and incident monitoring.
12. Liability
The Company shall not be liable for damages arising from:
- use or inability to use the website for reasons beyond the Company's control;
- actions of third parties who gained unauthorised access to a User's data;
- the User's provision of inaccurate or outdated information.
The User bears full responsibility for the accuracy of data provided and for compliance with these Terms.
13. Amendments to the Terms
The Company reserves the right to amend these Terms unilaterally. The updated Terms take effect upon publication on the website, unless otherwise specified in the amendment notice.
In the event of material changes affecting the processing of personal data, the Company will notify Users by posting a notice on the website or sending an email notification (where contact details are available).
14. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the applicable law depending on the User's jurisdiction:
- for Users from the Republic of Kazakhstan — the laws of the Republic of Kazakhstan apply;
- for Users from the Russian Federation — the laws of the Russian Federation apply;
- for Users from EU member states — EU law, including the GDPR, applies.
Any disputes arising from the use of the website or the processing of personal data shall be resolved through negotiation, and if no agreement can be reached, through the courts at the Company's place of registration or another competent court in accordance with applicable law.
